1. Acceptance of Terms
By accessing or using Spotted ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.
2. Use of the Service
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Post content that is illegal, harmful, threatening, abusive, or violates any laws
- Impersonate any person or entity or falsely state or misrepresent your affiliation
- Upload, post, or transmit any content that infringes on intellectual property rights
- Engage in any automated use of the system, such as using bots, scrapers, or data mining
- Interfere with or disrupt the Service or servers or networks connected to the Service
- Collect or store personal data about other users without their express permission
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Content and Intellectual Property
You retain ownership of any content you post on the Service. However, by posting content, you grant Spotted a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display such content in connection with the Service.
You represent that you own or have the necessary rights to post the content, and that posting it does not violate any third-party rights.
5. Zero Tolerance for Objectionable Content and Abusive Users
Spotted has a zero-tolerance policy for objectionable content and abusive users. We are committed to maintaining a safe, respectful, and positive environment for all users. This means:
- We do not tolerate any form of objectionable content, including but not limited to: explicit sexual content, violence, hate speech, harassment, bullying, threats, or any content that violates applicable laws
- We do not tolerate abusive users who engage in harmful behavior, harassment, intimidation, or any actions that create an unsafe environment for others
- Any user found posting objectionable content or engaging in abusive behavior will have their content immediately removed and their account permanently banned from the Service
- By using Spotted, you agree that you will not post objectionable content or engage in abusive behavior, and you understand that violation of this policy will result in immediate termination of your account
6. Content Filtering and Moderation
To protect our community, Spotted employs automated content filtering systems using machine learning models to detect and prevent objectionable content before it is published. Our content moderation system:
- Automatically scans all images and videos uploaded to the Service using advanced machine learning technology
- Blocks content that is determined to be objectionable, harmful, or in violation of our community standards
- Escalates content that requires human review for further evaluation
- Works continuously to improve detection accuracy and protect users from harmful content
While our automated systems are designed to catch objectionable content, they are not perfect. We rely on our community to report content that violates our policies, and we take all reports seriously.
7. Blocking Abusive Users
Spotted provides users with tools to protect themselves from abusive behavior:
- Block Users: You can block any user who is engaging in abusive behavior, harassment, or making you feel unsafe. When you block a user:
- They will not be able to view your profile, posts, or interact with you in any way
- They will not be able to send you messages or comments
- You will not see their content in your feed or receive notifications from them
- Blocked users remain blocked until you choose to unblock them
- You can manage your blocked users list at any time through your account settings
If you are being harassed or feel unsafe, we strongly encourage you to use the block feature immediately and report the user to our moderation team.
8. Reporting Objectionable Content and Response Commitment
If you encounter objectionable content or abusive users, you can report them directly through the Service:
- Report posts, comments, or users that violate our community standards
- Select from predefined report categories (spam, harassment, inappropriate content, etc.) or provide additional details
- All reports are reviewed by our moderation team
Our Commitment: We are committed to acting on all reports of objectionable content within 24 hours. When we receive a report:
- We will review the reported content or user behavior within 24 hours
- If the content violates our Terms of Service, we will immediately remove it
- If a user has engaged in abusive behavior, we will immediately eject (permanently ban) that user from the Service
- We will take appropriate action to prevent further violations
We take all reports seriously and investigate each one thoroughly. Your reports help us maintain a safe community for everyone.
9. Community Guidelines
In addition to our zero-tolerance policy, users are expected to treat each other with respect. Harassment, hate speech, discrimination, or any form of abusive behavior will not be tolerated. We reserve the right to remove content and suspend or ban accounts that violate these guidelines.
10. Termination
We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason. This includes, but is not limited to, posting objectionable content or engaging in abusive behavior, which will result in immediate and permanent account termination.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If we make material changes, we will notify users through the Service or by email. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
